Welcome to ClockWork Pro. By accessing or using our mobile application, web dashboard, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
"Organization" refers to the business entity (restaurant, retail store, or other company) that subscribes to ClockWork Pro.
"Admin" refers to the person who creates and manages the Organization's ClockWork Pro account.
"User" refers to any individual with an account on the Service, including Admins, Managers, and Employees.
"Employee" refers to a User whose account was created by an Admin or Manager for workforce management purposes.
To use ClockWork Pro, an Admin must create an Organization account. The Admin may then invite Employees by providing their email addresses. Employees will receive an invitation to set their own password. You are responsible for maintaining the security of your account credentials and for all activity under your account.
ClockWork Pro offers multiple subscription tiers — currently Free, Starter, and Business — each with its own employee and location limits and feature set. Our paid plans include Starter ($29/month) and Business ($79/month), which add features such as payroll export, messaging, reporting, and kiosk mode. The current employee/location limits, feature breakdown, and pricing for each plan are listed at clockworkpro.app/pricing and may be updated from time to time.
Subscriptions are billed monthly. You may cancel at any time, and your subscription will remain active until the end of the current billing period. We reserve the right to change pricing with 30 days' notice.
You agree to use ClockWork Pro only for its intended purpose of workforce management. You may not:
Your Organization retains ownership of all data entered into ClockWork Pro, including employee records, time logs, schedules, and messages. We do not claim ownership of your data. We use your data solely to provide and improve the Service, as described in our Privacy Policy.
As an Admin or Organization using ClockWork Pro:
ClockWork Pro includes geofence verification features that use GPS location data when Employees clock in or clock out. Organizations that enable this feature are responsible for informing their Employees about location tracking and obtaining any legally required consent. Location data is collected only at clock events and is not used for continuous tracking.
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance, and the Service may experience downtime due to factors beyond our control. We are not liable for any losses resulting from temporary unavailability of the Service.
To the maximum extent permitted by law, ClockWork Pro and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
ClockWork Pro is a workforce management tool, not a payroll processor or legal compliance service. We are not responsible for errors in payroll calculations, missed shifts, or any employment-related decisions made using data from the Service.
You agree to indemnify and hold harmless ClockWork Pro and its operators from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. You may close your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period as required by law or for legitimate business purposes.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to conflict of law principles.
